Colorado Open Records Request


In accordance with its statutory responsibilities, Archuleta County is committed to ensuring public access to County records within a reasonable time and at a reasonable cost. Certain County offices are bound by the Colorado Revised Statutes with respect to the timing and costs associated with providing such records. Elected officials and public offices have a duty to conduct government operations in compliance with Colorado law. Where legitimate questions arise regarding openness of meetings or accessibility of records, those matters should be addressed on a case-by-case basis in consultation with the County Attorney.

Pursuant to C.R.S. ยง24-72-202(6), โ€œpublic recordsโ€ include all writings made, maintained, or kept by any political subdivision for use in the exercise of functions required or authorized by law, or involving the receipt or expenditure of public funds. Criminal justice records are not included under Part 2 of the Act and are instead governed by Part 3.

โ€œWritingsโ€ are defined under C.R.S. ยง24-72-202(7) to include all books, papers, maps, photographs, cards, tapes, recordings, correspondence, and other documentary materials, regardless of physical form or characteristics. This definition includes digitally stored data, such as email communications, but does not include software.

Such public records are subject to inspection and/or copying in accordance with C.R.S. ยง24-72-203 and as otherwise provided herein.
